Terms of Use

These terms govern the use of the app “Noa” (listed in the app stores as “NoaIQ”), including its test versions (currently the Alpha). We kept them as short and clear as we could. How we handle your data is in our Privacy Policy. This is a translation for convenience; the German version is authoritative.

1. Who we are and who Noa is for

Noa is provided by Noa Cognition GbR, Verdistraße 21, 67227 Frankenthal (Pfalz) (more in the imprint), “we” below. The contract for using Noa is between you and us, not Apple. In the App Store and TestFlight the developer shown is Lukas Strickler, one of our partners, who publishes the app there on our behalf.

Noa is for people aged 16 and over. Anyone under 18 needs the consent of their parents or other legal guardians. The Alpha (section 8) is open to adults only. Noa is meant for personal use.

2. What Noa is

Noa is a workout for your brain, like the gym: games that call for memory, logic, reaction and focus. The games get harder or easier with you: easy to start, harder as you play better. From your games we calculate ratings: one per game, one per category, and the Noa Score. On top come social features: a profile, friends and leaderboards.

The Noa Score shows how well you do in Noa's games. It runs from 400 to 1,400 (shown as at most 1,399); everyone starts at 400, and over about the first seven days on which you play it settles to you.

Using Noa is currently free. If we later offer paid features (such as “Noa Pro”), separate terms we show you before purchase apply to them, and purchases go through the App Store. Apple's standard licence agreement for App Store apps also applies to the app licence; where the two conflict, these terms prevail.

3. Noa is a game, not a health service

Noa is not a medical device and not a health service. Noa makes no diagnoses, detects no illness, and does not replace any medical or psychological examination or treatment. Your ratings and the Noa Score describe how well you play our games, the way a chess rating describes how well someone plays chess. They and the category descriptions are not an IQ, not an intelligence test, not a measure of your mental performance and not a statement about your health, and they are not scientifically validated as any of these. We do not promise that Noa will change your health or mental performance. Noa is not made to answer questions about your health; for health questions, please see a doctor.

4. Your account

You can try Noa without an account first. For an account you sign in with your email address and a code we send you. The contract for using Noa is formed when you first sign in with the code or link. Please use an email address only you can access, and do not pass codes or sign-in links on to anyone. Each person may have only one account; accounts are not transferable.

5. Profile, username and visibility

Noa is a social app: competing with others, having friends and appearing on leaderboards is part of the game. That is why your profile is public by default: other users see your username, display name, your Noa (avatar), since when you have been a member, your ratings and Noa Score, your streak and your rankings. Through the link noaiq.app/u/<username> (in the Alpha staging.noaiq.app/u/<username>), anyone who has it can also see your display name, username and Noa, without ratings. The page asks search engines not to index it. We never show your email address.

You can make your account private in Settings at any time. Then only your friends see your ratings, Noa Score and streak, and on leaderboards you appear without a name. The page behind your link then shows only your username. Anyone signed in to the app who enters your exact username still sees your username, display name, Noa and since when you have been a member, even for a private account, so that you can add each other as friends. In the Alpha, the app's visibility settings do not yet take effect on our server: you choose before the invitation whether your profile should be public or private, and we set it for you. If you want to change it, write to privacy@noaiq.com; we switch your account without undue delay and confirm by email. The details are in the Privacy Policy (section 5.3).

Your username and display name are visible to others. They must not

  • be insulting, discriminatory, sexual, glorify violence or be otherwise unlawful,
  • pretend to be another person, Noa or a member of our team,
  • infringe others' rights, such as trademark or name rights,
  • contain contact details, links or advertising.

6. Fair play

Leaderboards only mean something if everyone plays fair. Please

  • play yourself: no bots, scripts, helper programs or aids that play for you,
  • do not manipulate results, ratings or streaks, and do not exploit bugs to do so,
  • do not interfere with running Noa, for example by overloading it, bypassing protections or accessing other people's data,
  • do not harass, threaten or insult anyone,
  • do not decompile or modify the app except where the law expressly allows it, and do not use Noa commercially.

We may check results automatically by replaying rounds on our server. Results that fail this check count neither for leaderboards nor for ratings.

7. Reports and measures

You can report a person directly in the app: open their profile, tap “Report or block”, pick a reason and tap “Report and block”. Our team reviews every report. The reported person is not told who reported them.

You can also report any username, display name or other content in Noa that you think is unlawful or breaks these terms by email to hello@noaiq.com. Your report should include the username or the exact place, an explanation of why the content is unlawful or breaks these terms, your name and email address, and a statement that your information is accurate and complete to the best of your knowledge. We confirm receipt and tell you our decision. This address is also our single point of contact for users and authorities under the Digital Services Act (Articles 11 and 12 DSA); you can write to us in German or English.

If someone breaks these terms, we may respond step by step and proportionately: change or reset a username or display name, remove results from leaderboards, reset ratings, suspend an account temporarily or, for serious or repeated breaches, terminate it. We take the circumstances of the case and your legitimate interests into account. People on our team handle reports and notices. Only two things are automated: (a) refusing names on save that break our word lists, and (b) the technical check of results under section 6. Whether a visible name is removed or an account is suspended is decided by people on our team. We tell you about a measure by email with our reasons: which measure, based on which facts, on which ground in these terms, and whether automated means were involved. Before we suspend or terminate an account we tell you beforehand and give you the chance to respond, unless a serious breach requires immediate action; in that case we do so without delay afterwards. You can contest any measure by email; we then decide again. You can also go to the ordinary courts at any time. We report indications of criminal offences threatening people's life or safety to the competent authorities.

8. Test versions (currently the Alpha)

While we distribute Noa as a test version through Apple TestFlight, the following also applies. Currently that is the Alpha: a test phase with a small group of people we invite by email only; there is no public link. We agree these deviations from what you could expect of a finished app with you expressly and separately when you agree to take part in the test phase (§ 327h of the German Civil Code):

  • A test version is a test. It may contain bugs, be unavailable at times, and features may change or be removed.
  • We may reset or recalculate game states, ratings, streaks and leaderboards of the test phase, for example when we improve the rating. When moving to the public version we may reset the test phase's data; we will tell you beforehand.
  • The Alpha contains usage analytics, which we use only with your consent; without this consent, joining the Alpha is not possible. Screen recording happens only if you agree to it separately; it is voluntary and not a condition of taking part (Privacy Policy, section 5.9).
  • We welcome feedback. You grant us a simple, free and unlimited right to use your suggestions to improve Noa. Please keep unreleased features confidential until they are released; there is no contractual penalty.
  • We may end the test phase or your participation with two weeks' notice by email, and immediately for security reasons or a serious breach of section 5 or 6. A test build can be used in TestFlight for at most 90 days; if we provide no new one or Apple ends distribution, the test phase ends when the last build expires, and we announce this beforehand where we can. The test phase runs on a separate test system, apart from the App Store version; your test account (in the Alpha, your Alpha account) does not automatically carry over to the public version. When the test phase or your participation ends, the contract for your test account ends too, and we delete it as described in the Privacy Policy.

9. Rights in Noa

The app, the games, texts, graphics, sounds and the Noa brand belong to us or our licensors. For the duration of this contract you get a simple, non-transferable right to use Noa for personal purposes. For your username and display name you grant us the rights we need to show them in Noa for as long as your account exists.

10. Availability and changes to Noa

We keep developing Noa. We may change games, features and how ratings are calculated where there is a valid reason, such as technical development, better or fairer ratings, security or changed legal requirements. This will not make Noa cost you more. If a change affects your use more than marginally, we tell you clearly by email in good time beforehand about the nature and timing of the change and about your right to end the contract free of charge within 30 days of that notice; you can also end it at any time by deleting your account. We provide the updates needed for Noa to work and stay secure through the App Store.

We try to keep Noa available at all times. Maintenance, security measures or disruptions beyond our control may limit use temporarily.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. For slight negligence we are liable only if we breach an essential contractual obligation, meaning an obligation whose fulfilment makes using Noa possible in the first place and on which you may regularly rely, and then only for the foreseeable damage typical for this kind of contract. Otherwise our liability for slight negligence is excluded. Your statutory rights regarding defects in digital products (§§ 327 ff. of the German Civil Code) remain unaffected.

12. Term and ending

The contract runs for an indefinite period. You can end it at any time without notice by deleting your account in the app (Settings, “Delete account”) or by writing to privacy@noaiq.com. We can end it with four weeks' notice by email. Both sides' right to terminate for good cause is unaffected; good cause for us includes in particular a serious breach of section 5 or 6, or one repeated after a warning. When the contract ends we delete your account as described in the Privacy Policy.

13. Changes to these terms

If we want to change these terms, we tell you beforehand in the app or by email and explain what changes. Changes apply only once you agree to them; your silence does not count as agreement. If you do not agree, the previous terms continue to apply; we may then end the contract with notice under section 12.

14. Right of withdrawal

If you are a consumer, you have the following right of withdrawal. Separately, you can end the contract at any time by deleting your account (section 12).

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded (section 4).

To exercise the right of withdrawal, you must inform us (Noa Cognition GbR, Verdistraße 21, 67227 Frankenthal (Pfalz), phone +49 151 53820001, email hello@noaiq.com) of your decision to withdraw from this contract by a clear statement (for example an email or a letter sent by post). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day we are informed of your withdrawal. As Noa is free to use, there are usually no payments. On withdrawal the contract ends and we delete your account as described in the Privacy Policy.

Model withdrawal form

(If you want to withdraw from the contract, please fill in this form and send it back.)

To Noa Cognition GbR, Verdistraße 21, 67227 Frankenthal (Pfalz), email hello@noaiq.com:

15. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of that country's mandatory law. The German version of these terms is authoritative; the English version is for information. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Questions and complaints are best sent directly to hello@noaiq.com.
